Terms of Service

By accessing or using RetireWise ("the Service"), available at retirewise.me, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and RetireWise ("we," "us," or "our"). Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

RetireWise is a professional-grade retirement planning platform that provides calculators, analytical tools, and educational resources to help users plan for retirement. Our Service includes, but is not limited to:

• Retirement readiness calculators and savings projections
• Monte Carlo simulations for portfolio outcome modeling
• Portfolio analysis across multiple asset classes
• Social Security benefit optimization and break-even analysis
• Roth conversion analysis and tax bucket planning
• Compound growth calculators with inflation adjustments
• What-if scenario modeling and stress testing
• Professional-grade insights and personalized recommendations

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

Certain features of the Service require you to create an account. When registering, you agree to provide accurate, current, and complete information. You may create an account using email and password credentials or through third-party OAuth providers (such as Google). Regardless of the authentication method you choose, you are responsible for:

• Maintaining the confidentiality and security of your account credentials
• All activities that occur under your account
• Promptly notifying us of any unauthorized use of your account or any other breach of security
• Keeping your account information up to date, including your email address and any profile details

You may not share your account credentials with any third party or use another person's account without their permission. We reserve the right to disable any account at any time if we reasonably believe you have violated these Terms.

RetireWise offers a free tier with limited access to certain features and calculators. To unlock the full suite of tools, including advanced Monte Carlo simulations, scenario modeling, and professional-grade insights, a paid subscription is required.

All paid subscriptions are processed through Stripe, our third-party payment processor. By subscribing to a paid plan, you agree to the following:

• Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your selected plan) unless you cancel before the renewal date.
• Billing: You authorize us to charge your designated payment method for all applicable fees. Prices are listed on our pricing page and may be updated from time to time with reasonable notice.
• Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features through the end of your current billing period. No partial refunds are provided for unused time within a billing cycle.
• Refunds: We do not offer refunds for subscription fees already charged, except where required by applicable law.
• Price Changes: We may change subscription pricing at any time. Existing subscribers will be notified at least 30 days before any price increase takes effect on their account.

RetireWise is not a registered investment advisor (RIA), broker-dealer, financial planner, or tax advisor. The Service does not provide personalized financial advice, investment recommendations, or tax guidance tailored to your individual circumstances.

All calculators, projections, Monte Carlo simulations, and analytical tools provided through the Service are intended solely for informational and educational purposes. Results generated by the Service are based entirely on user-provided inputs, assumptions, historical data, and statistical models. These results:

• Do not constitute a recommendation to buy, sell, or hold any investment or financial product
• Are not guarantees or predictions of future performance, returns, or outcomes
• May differ materially from actual results due to market conditions, tax law changes, personal circumstances, and other factors beyond our control
• Should not be the sole basis for making any financial, investment, tax, or retirement planning decisions

Past performance, whether historical or simulated, does not guarantee future results. You should consult with a qualified financial advisor, tax professional, or other appropriate specialist before making any financial decisions. You assume full responsibility for any actions taken based on information provided by the Service.

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, calculators, simulation engines, analytical methodologies, software code, user interface designs, and documentation — are the exclusive property of RetireWise or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial retirement planning purposes, subject to these Terms. This license does not include the right to reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the Service without our prior written consent.

When using the Service, you agree to the following:

• Accurate Data: You are solely responsible for the accuracy and completeness of any data, financial information, or assumptions you provide. The quality of the Service's output depends directly on the quality of your inputs.
• Lawful Use: You will not use the Service for any unlawful purpose, including but not limited to fraud, money laundering, or any activity that violates applicable local, state, national, or international laws and regulations.
• No Reverse Engineering: You will not attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of any software, algorithms, or proprietary methodologies underlying the Service.
• No Unauthorized Access: You will not attempt to gain unauthorized access to any portion of the Service, other users' accounts, or any systems or networks connected to the Service.
• No Interference: You will not interfere with or disrupt the integrity or performance of the Service, including through the use of bots, scrapers, automated scripts, or other tools designed to access the Service in an unauthorized manner.
• No Redistribution: You will not redistribute, resell, or commercially exploit the Service or any data, results, or content obtained through the Service without our prior written consent.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RETIREWISE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

WITHOUT LIMITING THE FOREGOING, RETIREWISE IS NOT LIABLE FOR ANY FINANCIAL LOSSES, INVESTMENT DECISIONS, TAX CONSEQUENCES, OR RETIREMENT PLANNING OUTCOMES THAT RESULT FROM YOUR USE OF OR RELIANCE ON THE CALCULATORS, PROJECTIONS, SIMULATIONS, OR ANY OTHER OUTPUT OF THE SERVICE.

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of (a) the total amount you paid to RetireWise during the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

We reserve the right to suspend or terminate your account and access to the Service, in whole or in part, at any time and for any reason, including but not limited to:

• Violation of these Terms or any applicable law or regulation
• Conduct that we reasonably believe is harmful to other users, third parties, or the business interests of RetireWise
• Extended periods of account inactivity, as determined at our sole discretion
• Requests by law enforcement or other government agencies

Upon termination, your right to use the Service will immediately cease. We may, at our sole discretion, delete your account and any associated data. Provisions of these Terms that by their nature should survive termination shall remain in full force and effect, including but not limited to Sections 5, 6, 8, and 11.

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page and, where practicable, provide notice through the Service or via email to the address associated with your account.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue your use of the Service and, if applicable, cancel your subscription.

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the United States. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts of competent jurisdiction, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
